California Privacy Notice

This California Privacy Notice (the “Notice”) applies to California “consumers,” as defined by the California Consumer Privacy Act of 2018 (“CCPA”).  This Notice modifies and adds to the general Privacy Policy available at http://sumforteams.com/privacy-policy, which is incorporated herein by reference.

Categories of Personal Information Collected

Sum! has collected the following categories of personal information from California consumers in the past 12 months:

  • Identifiers (e.g. name, mailing address, email address, phone number, credit/debit card number).
  • Characteristics of protected classifications (e.g. gender, age).
  • Commercial information (e.g. products or services purchased, purchase history).
  • Internet or other electronic network activity (e.g. browser or search history).
  • Geolocation data (e.g. latitude or longitude).
  • Audio, electronic, visual, or similar information (e.g. recording of guest service calls).
  • Professional or employment related information (e.g., occupation, job title, or professional association membership.
  • Inferences drawn from any of the above (e.g. preferences or characteristics).

Categories of Sources from which Personal Information Has Been Collected

Sum! has collected personal information about California consumers from the following sources in the past 12 months:

  • Our consumers (through our Applications or our customer or technical support services).
  • Our vendors and other service providers (including data analytics providers and advertising networks).
  • Third-party websites.

Business or Commercial Purposes for which Personal Information Has Been Collected or “Sold”

Sum! has not sold and will not sell your personal information to data brokers or other third parties for money.  For other business or commercial purposes, however, we may transfer or disclose your personal information as explained in this notice.  Although not made in exchange for money, some of those transfers or disclosures might constitute the “sale” of personal information under the broad definition set forth in the CCPA, California Civil Code section 1798.140.

Accordingly, please be aware that Sum! has collected or “sold” personal information about California consumers in the past 12 months for the following business or commercial purposes:

  • Providing products and services, including maintaining, protecting, or improving our Applications; maintaining or servicing accounts; analyzing and evaluating the performance, effectiveness, and security of our Applications, and similar or related services.
  • Processing payments and transactions.
  • Marketing, including developing and providing promotional and advertising materials that may be of interest to you; analyzing the effectiveness of those materials and customizing and improving them
  • Communicating with consumers and managing customer relationships, including providing customer or technical support; analyzing, evaluating, and improving the effectiveness of our support and communications; and verifying customer information.
  • Research, including technological development and demonstration.
  • Security, including preparation for, detection of, and remediation of security incidents.
  • Legal reasons, including obtaining legal advice or establishing, exercising, or defending against legal claims; complying with laws, regulatory requirements, contractual obligations, court orders, other legal process or obligations, or lawful requests from public and government authorities; detecting, preventing, and responding to fraud, intellectual property infringement, security issues, violations of our agreements, violations of law, or other misuse of our Applications or other products or services; and protecting the safety, rights, welfare, or property of Sum!, you, or others.

In addition, we may use personal information for any other purposes for which we provide specific notice at the time of collection.  We may also de-identify or aggregate personal information and use such data for any lawful purpose.

Categories of Personal Information “Sold” or Disclosed for a Business Purpose

Again, Sum! has not sold and will not sell your personal information for money.  Some of its transfers or disclosures, however, might constitute the “sale” of personal information under the CCPA.  Therefore, please be aware that Sum! has “sold” or disclosed for a business purpose the following categories of personal information in the past 12 months:

  • Identifiers (e.g. name, mailing address, email address, phone number, credit/debit card number).
  • Characteristics of protected classifications (e.g. gender, age).
  • Internet or other electronic network activity (e.g. “cookies” or other tracking tags).
  • Commercial information (e.g. products or services purchased, purchase history).
  • Internet or other electronic network activity (e.g. browse or search history).
  • Professional or employment related information (e.g., occupation, job title, or professional association membership.
  • Inferences drawn from the above categories of information (e.g. preferences or characteristics).

Information in these categories has been shared with our service providers and potentially with other users (for example, to the extent that a user has allowed his or her personality assessment to be incorporated into a team evaluation).

Sum! does not have actual knowledge that it sells or discloses the personal information of minors under 16 years of age.  To the extent that we become aware that such sale or disclosure might be occurring, we will take steps to prevent such events, and/or we will modify this Notice to describe those events and the related rights and choices of our consumers.

Privacy Rights

California consumers have the right to make certain requests about their personal information under the CCPA.  Specifically, if you are a California consumer, you may request that we:

  • Provide access to and/or a copy of certain personal information we have about you.
  • Provide information (up to twice in a 12-month period) about: the categories of personal information we collect, disclose, or sell about you; the categories of sources of such information; the business or commercial purpose for collecting or selling your personal information; and the categories of third parties with whom we have shared personal information during the past 12 months.
  • Delete certain personal information we have about you.

You may exercise these rights by submitting a request to us at support@sumforteams.com.  In reviewing and responding to such requests, we will undertake reasonable efforts to verify your identity by, for example, matching any information you provide in the request with information we maintain.

Please also note that most of these rights are not absolute, and our response may be limited as permitted by the CCPA. For example, the right to have personal information deleted is subject to a number of exceptions set out in the CCPA, such as when we need to maintain the information to provide products or services you requested or to comply with our legal obligations.

“Do Not Sell My Personal Information”

If you are a California consumer, you also have the right under the CCPA to request that we not sell your personal information.  Click here support@sumforteams.com to make such a request.

Non-Discrimination

Under the CCPA, California consumers also have the right not to receive discriminatory treatment for exercising their other rights.  Sum! will not discriminate against you because you exercise your rights. For example, Sum! will not deny you goods or services or charge you a different price or rate for goods or services if you make an access, deletion, or do not sell request.

Changes to This Notice

We may update this Notice from time to time.  Thus, we advise you to review this page periodically for any changes.  We will notify you of any changes by posting the new Notice on this page.  These changes are effective immediately after they are posted on this page.
